WHTTLESTONE EXPRESSER RENT-TO-OWN RENTAL AGREEMENT This agreement for the rental of a Whittlestone Breast Expresser Product and carrying case ("equipment") is made between Baby Belly Boutique and the rentee. The equipment remains the property of Baby Belly Boutique, LLC, 2281 Spinnaker Circle, Longmont, Colorado. The Renter has no rights to such equipment except as expressed in this agreement except after four months of rental and payment. The renter agrees to pay the rental fees in accordance with the fee structure. The 1st three months rental fee is due in advance, then a final payment of $97.50 is due on the fourth month of rental. The rental rates for the equipment and the purchase price for the kit do not include any applicable sales or use of tax. The renter agrees to purchase the double collection kit for $45. The renter agrees to inform the Rental Station of any changes of address. The renter agrees to allow no person other than the the renter to use the equipment provided. The agrees to return the equipment in clean condition. If the equipment is not clean, the renter agrees to pay a minimum cleaning fee of $10.00 The renter agrees to return the equipment in good repair. If the equipment is not in good repair, the renter agrees to pay a minimum repair fee of $30.00. This Agreement shall be construed under the laws of the State where Baby Belly Boutique, LLC. is located. The renter shall be responsible for all reasonable legal fees and other costs involved in collection of overdue amounts and / or recovery of leased equipment. The renter will notify Baby Belly Boutique by telephone or mail if the renter decides to return the pump before the fourth month of the agreement. Rental payments will not be terminated without notification. The Rental Station has the right to cancel this agreement at any time with three days notice. Baby Belly Boutique, LLC warrants to repair or replace any equipment which is or becomes defective under normal use. Baby Belly Boutique, LLC. will not be liable for incidental or consequential damages resulting from defective equipment; their liability is limited to repair or replacement of the equipment. This warranty is given in lieu of all other warranties expressed or implied. Collectable upon signing of Rental Agreement: Double Collection Kit $45.00 1st Month Rental $45.00 2nd Month Rental $45.00 3rd Month Rental $45.00 Totaling $180.00 A total of $180.00 will be collected for first payment, than on the fourth month of rental the renter pays $70.00, and the Expresser is theirs to keep. There will be no prorating of rental agreement until after the third month of rental. The breast expresser can be returned after the third month (not prior) of rental or purchased for an additional $97.50. The renter shall be responsible for all shipping and insurance fees related to returning the rental equipment to the Baby Belly Boutique at the end of their rental term. If the rental equipment is lost or damaged during the return, the renter shall be completely responsible for payment of the remaining cost (the difference between the amount paid and the amount due) of the rental equipment.
